Statutory Investigative Laws

The Department of Health and Human Services (DPHHS) is authorized to protect aged persons, adults with disabilities and adults with developmental disabilities, who are abused, neglected, sexually abused or exploited.

The Department is authorized to investigate reports of abuse, neglect, sexual abuse and exploitation involving older persons and persons who are developmentally disabled.

Montana has enacted adult protective services legislation. Those statutes include:

  1. The Protective Services Act for the Aged Persons or Disabled Adults, MCA 52-3-201 and
  2. The Montana Elder and Persons with Developmental Abuse Prevention Act, MCA 52-3-801.
