Swimming Pools, Spas and other Water Features
Important Information for Rules Begining January 1, 2019.
The Department is currently transitioning from the 2011 version of the swimming pool rules to the 2019 version. The 2019 version will go into effect on January 1st. The rule is only currently available as Montana Administrative Rule Notice or MAR notice. However the official Administrative Rules of Montana (ARM) will be posted as soon as they become available. The ARM adopts two documents. The first is the ISPSC (link to below). This document contains the construction requirements and a few operational requirements for new pools built in Montana. The other is Circular FCS 3-2018. This document contains most of the operational requirements for pools in Montana (link below). If you have an interest in pool operation, maintenance, or related public health please take the time to review these documents and contact this office with any questions. Circular FCS 3-2018 and the International Pool and Spa Code go into effect on January 1st 2019.
The 2011 rule related to pools, spas, and other water features will no longer be active after December 31st 2018.
When reviewed in combination these two documents provide the language for the rule that adopts the new pool circular (see above) and the ISPSC (also see above).
New construction and remodels must now be reviewed by both DPHHS and Department of Labor and Industry Building Codes (DLI). Please refer to the following DLI website to find contact information for the appropriate building codes official, Certified City, County, and Town Programs. Contact the State Building Codes Bureau for projects being built in a jurisdiction that is not certified for swimming pools.
