Commonly Used Terms
Americans with Disabilities Act (ADA): A civil rights law that defines “disability” and prohibits discrimination of individuals with disabilities by employers, any facility open to the general public, and state and local public agencies that provide such services as transportation (Public Law 101- 336).
Emergency Care Plan (ECP): An Emergency Care Plan is developed for any student who may require emergency services at school based upon his/her unique health care needs. The plan describes how to intervene in a health emergency. The plan is shared with staff that interact with the student on a routine basis. The School Nurse provides training related to the plan as needed.
Free Appropriate Public Education (FAPE): Special education and related services provided at public ex-pense and that meet state education agency standards and are (FAPE) consistent with the student’s individualized education program
Family Education Family Education Rights and Privacy Act (FERPA)—A federal law that Rights and Privacy Act protects the privacy and transfer of student education records.
Individuals with Disabilities Act (IDEA): The federal law that provides the legal authority for early intervention and special educational services for children birth to age 21. Part B outlines services for children ages three to 21. Part C outlines services for children birth to age three
Individualized Education Plan (IEP): A special education service plan for a student’s school program that is required for all students eligible for special education. The IEP outlines a student’s annual goals, short-term goals and objectives, and any related services.
Individualized Health Care Plan: A plan used by the school nurse, and, as appropriate other members of the school team to meet the health needs of a student.
Least Restrictive Environment (LRE): To the maximum extent possible, students with disabilities should be educated with students without disabilities. Removal of students with disabilities from the general educational environment occurs only when the nature or severity of the disability is such that education in regular classes with the use of supplementary aids and services cannot be achieved satisfactorily.
Licensed Medical Provider (LMP): A physician, hospital, hospital-related facility, long-term care facility, dentist, osteopath, chiropractor, optometrist, podiatrist, psychologist, licensed social worker, registered pharmacist, or advanced practice registered nurse, as specifically listed in 37- 8-202, who treats any illness or injury within the scope and limitations of the provider’s practice or any other person who is licensed or otherwise authorized in this state to furnish health care services.
Other Health Impairment (OHI): A categorical label for special education eligibility that refers to “a student with limited strength, vitality, or alertness, due to chronic or acute health problems, which is anticipated to be of more than three weeks’ duration” and which adversely impacts educational performance.
Paraprofessional: School personnel who work along-side of and under the direction of a licensed educator or related services provider to assist in implementing a student’s education program.
Related Services: Related services as defined (in part) by IDEA means transportation and such developmental, corrective and other supportive services designed to enable a child with a disability to receive FAPE as described in the IEP. The term includes school nurse services.
Section 504 of the Federal Rehabilitation Act: Legislation passed to protect the civil rights of people Rehabilitation Act with disabilities. The law is aimed also at schools, in an attempt to prevent them from excluding students with health impairments or from restricting an educational program for such students
Unlicensed Assistive Personnel (UAP): Individuals who are not authorized (by licensure) to provide health care services, including health assessment and health care interventions, acts, or tasks. In nursing, UAP refers to personnel who are not licensed to practice nursing but who are trained to assist nurses in implementing health care activities that are within the scope of nursing and do not require assessment or judgment.
