Public Access Automated External Defibrillator (AED) Programs
An AED is used when a person is unconscious and not breathing normally. Anyone can operate an AED by following the prompts provided by the device. There is no requirement for prior CPR training to use an AED. Publicly accessible AEDs improve survival from cardiac arrest.
Program Requirements
The statute for public access AEDs for Montana has been changed, effective October 1, 2025. Please see requirements below:
- AED owners must complete the Notification Form and provide it to local 9-1-1 dispatch center(s) to inform them of the location of AED(s) and your program contact information.
- Maintain, test, and operate the AED according to the manufacturer's guidelines. Keep records of all maintenance and testing performed. (Example inspection/maintenance form)
- Each time an AED is used (regardless of whether a shock was delivered), summon EMS via 9-1-1 to provide assistance.
- AED owners and users benefit from liability protections. See MCA for details.
NOTE: There are additional requirements for public schools covered by other statutes and administrative rules.
Best Practices (Not Required in Statute):
- Perform and document AED maintenance and testing monthly.
- Develop a written plan for your AED program that addresses CPR training, AED use, maintenance/upkeep, and user training. (Example AED program plan) This can be integrated into a general safety plan.
- Have practice drills to review the plan and adjust as needed.
