Surrogacy

The Office of Vital Records creates new certificates in the case of surrogacy. Our office should be involved once a pre-birth order is created. Sending the certified pre-birth order to us before the birth takes place gives our office a heads up that the surrogacy is taking place so that we are prepared to create a sealed file and a new certificate once the birth happens. Once the child is born, a certified post-birth order or a notarized affidavit of birth and a photocopy of your photo ID should be sent to our office here:

Without these documents, a birth certificate cannot be issued.

Please note that a birth certificate is not automatically issued for free. See the Birth/Death Certificates Page for how to order a copy of the birth certificate once it is processed.

Legal action processing time for surrogacy:

  • 3-4 months for creating new certificates
  • Currently working on orders received on 3/13/2024

Legal action applications are processed in the order they are received. Please note that we do not make exceptions to this.
